Terms of Service

1. Who we are

Expandable Education is operated by EXPANDABLE EDUCATION (PTY) LTD, a private company incorporated in South Africa (registration number 2026/675875/07), of 7 Carbrook Avenue, Claremont, Cape Town, Western Cape, South Africa, 7708 (“Expandable Education”, “we”, “us”, “our”). These Terms of Service (“Terms”) form a binding agreement between you and us governing your use of the Expandable Education website, application, and related services (the “Service”).

2. Acceptance

By creating an account, purchasing a subscription, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service. If you are entering into these Terms on behalf of a school, tutoring company, or other organisation, you confirm you have the authority to bind that organisation, and “you” refers to both you and that organisation.

3. Eligibility and minors

You must be at least 13 years old to create an account. If you are under 18, you confirm that a parent or legal guardian has consented to your use of the Service and to these Terms on your behalf, and that consent is a condition of your continued use. Schools, tutoring companies, and other organisations that create or purchase accounts on behalf of students represent that they have obtained any consent required by applicable law (including consent from a parent, guardian, or the student, as applicable) before doing so, and take responsibility for appropriate use by those accounts.

4. Accounts

• You are responsible for keeping your login credentials secure and for all activity under your account
• One person, one account — you may not share accounts or credentials
• You must provide accurate registration information and keep it up to date
• We may suspend or terminate an account that violates these Terms, is used fraudulently, or is used to circumvent usage limits (e.g. sharing an account to exceed a question allowance)

5. Acceptable use

You agree not to: scrape, reverse-engineer, or bulk-extract questions, mark schemes, or other content from the Service; resell, sublicense, or redistribute Service content or access; attempt to circumvent usage limits, paywalls, or security controls; upload unlawful, infringing, or harmful content; or use the Service in any way that disrupts its operation or other users’ access. We may suspend or terminate access for any violation of this section without refund of amounts already paid, except as required by law.

6. AI-generated content

Questions, mark schemes, marking, feedback, predicted grades, and readiness scores are generated by artificial intelligence and are provided for practice and revision purposes only. They are estimates based on your activity and may contain errors, are not guaranteed to be accurate or complete, and do not constitute official exam board content, professional educational advice, or a guarantee of any exam outcome. You should always refer to your teacher, school, and the relevant exam board’s official materials for authoritative guidance. Reliance on any AI-generated output is at your own risk.

7. Subscriptions, payments, and refunds

• Prices are displayed in USD for reference but charged in South African Rand (ZAR) via our payment processor, Paystack, converted at the rate applicable at the time of charge
• Paid subscriptions renew automatically for successive billing periods (monthly or annual, as selected) until cancelled
• You may cancel at any time from your account settings; cancellation takes effect at the end of the current paid period, and you retain access until then
• Fees already paid are non-refundable except where required by applicable consumer protection law, or at our discretion on a case-by-case basis — contact hello@expandable.education
• We may change subscription pricing on notice; continued use after a price change takes effect constitutes acceptance for your next billing cycle
• Free-tier and trial usage limits (e.g. question allowances) are subject to change without notice

8. Intellectual property

All content on the Service — including questions, diagrams, mark schemes, software, design, and branding — is owned by Expandable Education or licensed from third parties, and is protected by copyright and other intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the Service for your personal (or, for school/institution accounts, internal educational) use. You may not copy, resell, sublicense, publicly display, or distribute Service content without our prior written permission.

9. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any predicted grade, readiness score, or exam outcome will be achieved. Nothing in this section excludes or limits any warranty or right that cannot lawfully be excluded or limited under applicable consumer protection law.

10. Limitation of liability

To the fullest extent permitted by applicable law: (a) neither party will be liable to the other for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or relating to these Terms or the Service, even if advised of the possibility of such damages; and (b) our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the total amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or ZAR 1,000 if you have paid us nothing. This limitation does not apply to liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by our negligence, fraud, or wilful misconduct, or as otherwise required by applicable consumer protection law.

11. Indemnification

You agree to indemnify and hold Expandable Education harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right, except to the extent caused by our own negligence or breach of these Terms.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access immediately for breach of these Terms, non-payment, suspected fraud or abuse, or as required by law. On termination, your right to use the Service ends immediately; sections of these Terms that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

13. Changes to these Terms

We may update these Terms from time to time. For material changes, we will provide reasonable notice (for example, by email or an in-app notice) before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles. Subject to any mandatory consumer protection rights you have in your own country of residence, the courts of South Africa have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. Before initiating formal proceedings, both parties agree to first attempt in good faith to resolve any dispute informally by contacting hello@expandable.education.

15. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Service.
